mCare LLC is an e-commerce retailer of healthcare products. We are not a healthcare provider, pharmacy, or medical device manufacturer unless explicitly stated on a Product page.
3. Eligibility to Purchase
By placing an order, you represent and warrant that:
- You are at least 18 years of age (or the age of majority in your state of residence, whichever is higher).
- You are not purchasing Products for resale, redistribution, or commercial use without our prior written consent.
- You will provide accurate, current, and complete billing and shipping information.

5. Orders, Pricing, and Payment
A. Order Acceptance. We reserve the right to refuse or cancel any order for any reason, including:
- Product unavailability or discontinuation.
- Pricing errors on the Site.
- Suspicion of fraudulent, reseller, or bulk-buying activity.
- Shipping address restrictions (e.g., PO Boxes for temperature-sensitive healthcare products).
B. Pricing. All prices are listed in United States Dollars (USD) and do not include applicable state sales tax, shipping fees, or customs duties (for international orders). We are a Wyoming LLC and collect sales tax where required by law.
C. Payment Methods. We accept wire transfer and crypto payments.
D. Pre-Order and Subscription Products. If you purchase a subscription Product, you authorize us to charge your payment method on a recurring basis (e.g., monthly) until you cancel. You may cancel subscriptions at any time via your account dashboard or by emailing customerservice@mcarehq.com.
6. Shipping, Delivery, and Risk of Loss
A. Shipping Carriers. We ship via USPS, FedEx, UPS, DHL depending on Product type and destination or by other international shipping companies. Our forwarder will always decide what is the best option for the specific shipment.
B. Title & Risk of Loss. Title to Products and risk of loss pass to you upon delivery to the common carrier (e.g., when USPS picks up the package). This means that if a package is lost or stolen after we hand it to the carrier, we are not responsible unless you purchased shipping insurance. Some shipments are guaranteed to arrive.
C. Temperature-Sensitive Products. If you purchase products requiring refrigeration, you agree to be present at the shipping address for delivery. We are not responsible for spoilage due to delayed delivery, porch theft, or improper storage after delivery.
D. Shipping Restrictions. We cannot ship certain healthcare products to the following locations due to state laws: Check your local laws before ordering.
7. Returns, Refunds, and Exchanges
Healthcare products often cannot be returned for safety reasons. Please read carefully.
A. Non-Returnable Items (Hygiene/Safety). Due to health and hygiene regulations, the Products are final sale and cannot be returned or exchanged.
B. Damaged or Defective Products. If you receive a product that is damaged or defective, contact us within 48 hours of delivery with photos of the damage and the lot number. We will provide a prepaid return label and issue a full refund or replacement.

You agree to notify us immediately at info@mcarehq.com if you experience any adverse reaction, side effect, or unexpected incident related to one of our Products. We are required by federal law (CFR Title 21) to report serious adverse events to the FDA. Your cooperation helps protect other consumers.
9. Prohibited Conduct

11. Limitation of Liability (Wyoming Law)
To the Maximum Extent Permitted by Wyoming Law (W.S. § 40-12-101 et seq. and Applicable Product Liability Statutes):
A. No Consequential Damages. In no event shall mCare LLC, its members, managers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Products or Site, including but not limited to personal injury, lost profits, lost data, or medical expenses.
B. Maximum Liability. Our total liability to you for any claim arising from these Terms or your purchase, regardless of the legal theory (contract, tort, warranty, or product liability), shall not exceed the amount you paid to us for the specific Product giving rise to the claim.
C. State Law Limitations. Some states (including Wyoming) do not allow the exclusion of certain warranties or limitations of liability for personal injury. In such cases, this limitation applies to the greatest extent permitted by law.
D. No Warranty of Medical Efficacy. We provide Products "AS IS" without any warranty that they will cure any condition or that use will be free from adverse reactions.
12. Indemnification
You agree to indemnify, defend, and hold harmless mCare LLC, its members, managers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

- Your violation of any federal, state, or local healthcare laws (e.g., reselling prescription-only items).

13. Dispute Resolution & Binding Arbitration (Wyoming)

A. Informal Resolution. Before filing a formal claim, you agree to contact us at info@mcarehq.com and attempt to resolve the dispute informally for at least 30 days.
B. Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or your purchase of Products shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.
C. Location & Law. The arbitration shall be held in Sheridan County, Wyoming, or via remote hearing if permitted. These Terms are governed by the laws of the State of Wyoming without regard to its conflict of laws principles.
D. Class Action Waiver. You and mCare LLC agree to arbitrate only on an individual basis. You waive the right to participate in a class action, consolidated action, or representative action. The arbitrator may not consolidate more than one person's claims.
E. Exceptions. Either party may bring an individual action in small claims court (subject to jurisdictional limits) or seek injunctive relief in Wyoming state or federal court to protect intellectual property rights.
F. Opt-Out Right. You may opt out of this arbitration provision within 30 days of your first purchase by emailing info@mcarehq.com with your full name, order number, and a clear statement that you opt out of arbitration.
14. Force Majeure
We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, natural disasters, pandemics, supply chain disruptions, FDA recalls, carrier strikes, or government regulations.
15. Severability & Entire Agreement
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between you and mCare LLC regarding the subject matter herein.
16. Changes to These Terms
We may update these Terms from time to time to reflect changes in healthcare regulations, our business practices, or Wyoming law. Material changes will be notified via email to active customers or via a banner on our Site. Your continued use of the Site after the effective date constitutes acceptance of the revised Terms.
